Our team understands that navigating the complex US legal system often brings up many pressing questions. We have compiled these frequently asked questions to provide clarity and help you feel more confident about your journey.
The timeline for a Green Card (Lawful Permanent Residency) varies significantly depending on your category.
Family-Based: For immediate relatives (spouses and children) of US citizens, it typically takes 6 to 12 months in 2026. However, siblings or adult children may wait years due to backlogs.
Employment-Based: Depending on your priority date and country of origin, wait times can range from 1 year to over a decade.
Yes, this is known as Adjustment of Status. If you are already in the US on a valid non-immigrant visa (like an H-1B or F-1) and become eligible for residency, you can often apply to change your status without leaving the country. However, you must ensure you do not violate the “dual intent” rules of your specific visa.
While both allow you to live and work in the US, there are critical differences:
Green Card: Gives you permanent residency, but you can still be deported for serious crimes and cannot vote in federal elections.
Citizenship: Achieved through naturalization (usually after 5 years of residency). Citizens cannot be deported, can vote, and can hold a US passport.
Yes. Permanent residents can lose their status and face removal proceedings if they commit certain “crimes involving moral turpitude,” drug offenses, or aggravated felonies. Additionally, if you stay outside the US for too long (typically more than 6 months to a year), the government may argue you have abandoned your residency.
If you receive a denial, do not panic, but act quickly. Depending on the reason, you may be able to:
File an Appeal: Submit a request to the Administrative Appeals Office (AAO).
Motion to Reopen: Provide new facts or evidence that were not available during the initial filing.
Reapply: In many cases, it is faster to fix the errors in your paperwork and submit a fresh application rather than fighting a long legal appeal.
